Try reading the Terms of Service ("TOS") for Craigslist or Apple. Holy Shiva! You almost need a law degree if you want to understand the repercussions of selling a couch or buying a song.

Continued use of this Site or link to this site constitutes agreement to these Terms. Please. Read. This.

Listen, we’re not fond of writing legal documents any more than you’re fond of reading them (or even pretending to read them). But, our lawyers say we need to set a few ground rules, so here we are. We’ve done our best to dig through the sludge and re-write it in clear and common language. Our intention here is that we can all understand it a little better. These days, it seems as though most people have the attention span of less than thirty seconds, especially on the Web. But, since you’re here to practice yoga, we’re going to assume your concentration level is a little more refined. (Or you're at least working on it.)

Look around… Buried deep within every TOS of every website you visit are provisions like these. The difference between their TOS and our TOS? We're being up front about it. And you can trust that we'll take this approach in everything we do because, basically, that’s how we roll.

NomadYOGI was created to connect Yoga Teachers and Yoga Venues with Yoga Students. In the process, we are fueled by feedback from everyone involved. If you find a hotel/retreat/class/teacher to be less than professional or not quite what it was advertised to be, or if it didn’t meet your reasonable expectations, and you feel our standard review system isn’t enough, we want to hear about it. Please leave a review and contact us directly at nomadyogi.uservoice.com. Moderators will expect you to be honest and constructive with your feedback. Bitterness doesn’t help the receiving party make any improvements and, frankly, makes you sound like a troll. Don’t post anything defamatory or fraudulent. Please don’t be rude. In the same effort, if you’ve found a hotel/retreat/class/teacher to be extraordinary, above and beyond your expectations, or altogether life-changing, we want to hear about that, too. Likewise, be honest and sincere – we love our yoga teachers too, but over-exaggerating their benefits by claiming they can cure cancer won’t help anyone in the NomadYOGI community.

It should go without saying, that you shouldn’t do anything illegal with us, but we have to say it anyway: you are required to comply with all laws, ordinances and regulations applicable to your activities on NomadYOGI. The contents of the site pages, including, but not limited to text, graphics and icons, are copyrighted materials owned or controlled by NomadYOGI and may contain NomadYOGI’s name, trademarks, service marks and trade names. You may download one copy of these materials on any single computer and print a copy of the materials for your use in learning about, evaluating, or acquiring services of NomadYOGI or its sites, services or products. No other permission is granted to you to print, copy, reproduce, distribute, transmit, upload, download, store, display in public, alter or modify these materials. The only permission granted here is for you to use NomadYOGI’s pages as a means to hyperlink other Internet sites with pages in the NomadYOGI Web site by clicking our “share this” icon.

Okay, so here's the thing: NomadYOGI is in the business of being available to our Users 24/7. However, we provide no assurance or guarantee of "up-time," or reliability. Yep, you read that right, but even Google suffers from outages. Furthermore, we also don’t guarantee to be free from errors, malicious code or even computer viruses. NomadYOGI is not responsible for any loss of data, financial loss, interruption in service, claims of libel or loss of appetite. We also can't be blamed for damages or loss from the User, or inability to access NomadYOGI, any linked content, or the reliance of any information on the NomadYOGI site. Additionally, we're a rapidly growing company that is constantly adding more and more features that we think you'll appreciate, as well as getting rid features that most users don't. So, don’t get too upset if a feature disappears. You may have been the only one using it.

NomadYOGI is provided without assurance or warranty of any kind. No warranty of fitness for any particular use, merchantability or non-infringement is made. Our users are uploading most of this information, not us. And besides, NomadYOGI is not a travel agent. NomadYOGI does not encourage, endorse or support any social events, including user meetings, without express prior approval – something we will actually do and we’ll be very clear about it when we begin holding our own workshops and events.

A word about Internet security: it is up to you to take precautions to ensure that whatever you select for your use or download is free of such items as viruses, worms, trojan horses and other items of a destructive nature. NomadYOGI assumes no responsibility for any other party's site hyperlinked to the NomadYOGI Web site or in which any part of the NomadYOGI Web site has been hyperlinked. Any effort to reverse engineer all or any part of NomadYOGI in order to identify, acquire, copy or emulate any source code or object code is expressly prohibited. This prohibition specifically applies, but is not limited to, software, applications and services for use or operation on or by any computer and/or any electronic, wireless and/or mobile device, technology or product that exists now or in the future.

We built it. It’s ours. Don’t copy it, steal it, or hack it.

If you desire to provide a hyperlink from your Web site to our Site, you must agree to be bound by the terms of our Terms of Service and any applicable licensing agreements. It would be impossible for us to consider all of the laws in all of the countries that NomadYOGI touches through users’ respective posts. Specifically, it is never our intent to violate any intellectual property rights or allow others to do so. Should an author or copyright holder find a reproduction, in whole or in part, to be offensive to either his host country's laws, or his personal beliefs in his property ownership, we invite him, her, or it to alert us to any perceived problem and we’ll do our best to resolve the issue in a timely manner.

NomadYOGI provides a venue for third-parties to enter into and complete transactions. We are not involved in processing transactions, our payment processor (PayPal) is. As a result, we have no control over the quality, safety, or legality of anything posted here. In no event will we be liable for any loss or damage, including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website. Stay with us here… Obviously, we are not responsible for the actions of any Users. We ordinarily conduct a very limited screening and verification process. Please use your common sense. Your health and safety is your responsibility. We hope this doesn't surprise you. The information we provide on this website should not be construed as personal medical advice or instruction. Likewise, while we do our best to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, services, or related graphics you see here. We make no representations with regard to the goods or services offered by users or other websites linked to this site. If you enter into a transaction with a third party and have a dispute over the goods or services you purchased, we have no liability for the goods or services underlying the transaction and have no obligation unless we have agreed to fund such transaction -- in which case our sole responsibility shall be to fund the transaction.

There are a few things we need to make clear about purchases made on NomadYOGI:

  • NomadYOGI provides a marketplace for third-parties to initiate and complete transactions. We are not a travel agent and we are not financially involved in these transactions.
  • Once a purchase is initiated, the buyer has 24 hours to request a refund through NomadYOGI. We will honor any request made within the first 24 hours of purchase. Refunds requested outside of this 24 hour period, however, will have to be taken up with the recipient of the payment. That’s right, the Event Creator, which may be your yoga teacher, who may have a NO REFUND POLICY.
  • If your travel plans change or you are unable to attend an event, we would be happy to facilitate the refund, up to 90 days from the transaction, through the process we have set up, according to our policies, but you will not be receiving a refund from us, you'd be receiving it back from whomever PayPal gave it to. If the Event Creator decides to issue a refund within 90 days, you will receive NomadYOGI’s transaction fees, as well.
  • Now, say the following outloud: By clicking "Book Now," I understand that, unless explicitly stated by NomadYOGI on behalf of the User who posted the event/retreat, my payments are non-refundable after 24 hours of making a payment, which thereafter may be surrendered in full. I understand that if I fail to make payments on an installment plan (if available), my previous payments will not be refunded to me. Why? Because I wholeheartedly make this commitment to my yoga practice and the service providers who enable and facilitate my practice, recognizing that demands for refunds and chargebacks unfairly impede their ability to provide such services. I will not demand a refund or attempt a chargeback. I understand that NomadYOGI is not the travel agent, teacher, host or owner of the venue for the event I will attend. Further, I understand that NomadYOGI is a community marketplace for venues and teachers but it has not necessarily vetted any of its Users and their qualifications. Ultimately, my choice to attend any event or learn from any teacher is just that: my choice. Each User is an independent or independently owned entity and is not related to NomadYOGI in any way. I agree by clicking below that NomadYOGI cannot be held responsible for any act of negligence by any User or any act of God (be it Jesus or Shiva) or force of nature (or Kali) or any circumstance that forces me to change my mind, mood, or travel plans. I further understand that this agreement is of no force and effect until I click “Book Now,” in which case I will be bound by all the terms and conditions contained herein. By clicking below, I show that I have read, and agree to, the terms above.

NomadYOGI is a social network that intends to be transparent, honest, clear and free-of-fluff. We request the same of our Users. (Yes, we do realize this means we won't be as big as the others… And we're totally cool with that.) In order to stay true to our vision, we'd like to be super clear about murky stuff. So, to review, here are some quick points about privacy, and a few additional ones we don’t feel need lengthy explanation:

  • Sometimes User’s stories are added through their personal blogs. Users retain full property rights to their own blogs, granting NomadYOGI license to use their additions indefinitely. NomadYOGI does not review or condone, implicitly or explicitly, the material published.
  • Depending on what you want from NomadYOGI, we may require your email. (Kinda hard to send you newsletters or password resets when we don't have it, for instance). We occasionally use this data to screen out repeat registration and the like. We do not and will not sell your email to anyone outside of our system for marketing purposes. We hate SPAM as much as you do. Probably more. NomadYOGI, from time to time, may collect information from readers. If you give it to us, we can use it. True story: NomadYOGI once wrote a Privacy Policy addressing this. By agreeing to these Terms, you expressly agree to the terms of this Privacy Policy, as well.
  • We reserve the right to modify any terms and conditions of userdom at any point, without notification.
  • You agree to indemnify and hold NomadYOGI and its representatives harmless from and against any third-party claim or damages related to or arising out of your own conduct or activities on, through or related to NomadYOGI. This indemnification obligation includes payment of any attorneys' fees and costs incurred by NomadYOGI and its representatives.
  • Users may be banned or removed from the system without notification or due process of any sort. Vanity URLs (a.k.a Profile page names) should not be seen as a representation of NomadYOGI by the user, nor are they intended to be a reflection of by NomadYOGI, an online or real life identity. NomadYOGI reserves the right to retake and reuse Vanity URLs at will and without notice or due process of any sort.

For Business Users, i.e. Yoga Teachers, and Assorted Venues & Advertisers

  • If you make purchases, such as advertising, and your payment method fails or your account is past due, we may take steps to collect past due amounts using collection mechanisms. Users shall pay all expenses associated with such collection, including attorneys' fees. Interest will accrue on any past due amounts at the rate of the lesser of 1.5% per month or the lawful maximum.
  • Advertising or other services may be canceled at any time through our online portal. Processing cancelations in this way might take up to several days, during which time you are still responsible for any charges incurred.
  • When listing your event, be sure to enter the total number of students that your event can hold. Users will see this as "number of spaces available" in connection with your event. NomadYOGI will help you monitor your event's registration or attendance but you are responsible for managing it attendance correctly. This means that if you do not have the numbers needed to run your event, or if you decide to cancel an event, it is your responsibility to communicate this to your registrants as well as process any refunds necessary. NomadYOGI can help facilitate refunds though our system, but we are not liable for any cancellations, chargebacks or further transactions.

We reserve all rights, including the right to modify the terms of this disclosure without notice. Obviously we want to keep all of our Users informed. If we modify our Privacy Policy, we will post the modification on the Site, or provide you with notice of the modification via email. We will also update the “Last Updated Date” at the top of this Privacy Policy so you know when we changed something. By continuing to access or use the Site, Application or Services after we have posted a modification, you are indicating that you agree to be bound by the modified Terms of our Policy. This means that if the modified Terms are not acceptable to you, your only recourse is to cease using the Site and our Services.
